General Information

This website is to provide recruitment support service to both Job applicants and Employers & Advertisers. Access to and use of the contents and services provided on this site shall be subject to the term and conditions and the privacy policy Statement below.


Please read the Terms and Conditions and the Privacy Policy carefully. By accessing to the Site, uploading, viewing or obtaining information there from, or by using the Services, you as a User acknowledge that you have read, understood and agreed to be bound by the provisions contained in the Terms and Conditions and the Privacy Policy. If you do not accept either or both of the Terms and Conditions and/or the Privacy policy statement, please do not join, access, view, download or otherwise use any services offered by Top Leader via this Site. Your access to this Site and Top Leaders services will be terminated upon your notice to Top Leader that any change is unacceptable; otherwise your continued use shall constitute your acceptance of all changes and they shall be binding upon you.


Top Leader reserves the right to amend the Terms and the Privacy Policy at any time from time to time without prior notice. Therefore, you are advised to review the Terms and the Privacy Policy periodically.

 

Definitions

In these Terms and Conditions, the following terms shall have the respective meanings specified below unless the context otherwise requires:

“Top Leader”
means Top Leader Group International Ltd..

"Advertiser"

means a User who places a job advertisement, uploads recruitment information or promotes any employment related activities on the Site. An Advertiser includes an Employing Advertiser and an Agent Advertiser.

"Job Applicant(s)”
means users who intends to seek employment by using this site.
“Site”
means any website, job portal , system or mobile application owned and operated by Top Leader and its subsidiaries which is developed and operated by Top Leader for Job Applicants to make job applications and communicate with Advertisers for job seeking purposes, and for Advertisers to receive applications from and communicate with Job Seekers for recruitment purposes.
"Hong Kong"
means the Hong Kong Special Administrative Region of the People's Republic of China.
“Services"
means any services provided by Top Leader Group International Ltd. to any users
"Service Fee"
means the fee payable by Advertiser to Top Leader in consideration of the Services provided by Top Leader, subject to the provisions stipulated in the Terms and Conditions and the Service Fee and Payment Policy.

"User(s)"
means any user of the services and the site including both Advertisers and Job Applicants.

The terms “you” herein refer to all individuals and/or entities accessing and/or using the Site at any time for any reason or purpose.

 

1. Use of the Site
         
           A- Job Applicants

  • Job Applicants shall use this website and services for lawful and job seeking purposes only.  There is "Free of Charge" for Job Applicants to search and apply the jobs in the site.  

  • By submitting his/her resume and application information to this Site, applicants agree that he/she is responsible for providing his/her personal information such as personal particulars, education background, work experience, qualifications and other relevant information, to the database of Top Leader, when he/she applies for the job vacancy on the Website or authorize Top Leader to keep your resume for our continuous support in your job seeking activities. Applicants confirm and acknowledge that his/her personal data or information will be disclosed to the Advertisers and/or Top Leader when applicants use this Site for purposes of submitting, uploading or posting his/her resume on this site at his/her own risk. By submitting his/her resume on this Site, applicants authorize Top Leader to store his/her resume and Personal information or related data thereto in the database system of Top Leader, until and unless such Personal information is deleted or de-activated by the applicants.

  • Applicants agree to keep his/her login-ID and password confidential with care in order to prevent any leakage of confidential and personal information to any third-parties and shall notify Top Leader immediately of any unauthorized use of the same.

  • Applicants may send his/her resume and the related information or data directly to any Advertiser who advertises on or through this site. Top Leader is not responsible for the content of the Employer’s application form, emails, testing assessments , screener questions or their format and that Top Leader does not guarantee receipt of his/her application by the Employer, or his /her receipt of emails from the Employer. Top Leader also does not guarantee that any Employer will receive, access, read or respond to any such resume or application material, or that there will be no mistakes in the transmission of the data. At the same time, applicant’s resume and the related information or data will remain active on the Site and be stored in the Database at his/her own risk unless and until he/she chooses to delete them.

  • Applicants acknowledge and agree that his/her resume and the related data may be accessed by the Advertisers who have subscribed to the services of Top Leader for the sole purpose of recruiting and assessing the suitability of Job applicants. Top Leader also reserves the right to disapprove, reject or edit any part of the applicants' resume and the related data as it seems appropriate and to erase any personal data which Top Leader reasonably believes that such data are inaccurate, false, illegal, unlawful, infringe copyright / trademark / trade name / trade secret or infringe any other intellectual property rights or invade the privacy of the other having regard to the purpose for which the data are or are to be used. Top Leader does not guarantee the validity of a job offer and cautions Job Seekers to verify the validity of a job offer before taking an adverse action regarding their current employment situations.

  • By creating a resume through this site, applicants are requesting and authorizing Top Leader to make available your resume to any Employer that Top Leader believes may have an interest in your resume. Applicants agree and acknowledge to Top Leader’s practice of charging Advertiser a fee for access to the site, the Database and Job applicants’ resumes, details and the related information or data for the sole purpose of recruiting and assessing the suitability of Job applicants and subject to the terms herein. Applicants also recognize that he/she shall have no claims to any such fee received by Top Leader.

  • Top Leader will NOT release applicant’s personal data to any Advertiser without his/her permission unless required by any authorized institution or obliged under the prevailing laws and regulations. Applicants agree that Top Leader may use the Personal Information for marketing purposes which may be directed to potential Advertisers, their respective agents or anyone under their employ.

  • Top Leader shall use its reasonable endeavors to restrict access to the Database only to the Advertisers and personnel of Top Leader; however it does not guarantee that other parties will not gain access to the Database, without Top Leader’s consent.

    Applicants accept that all personal data, information or materials given to Advertiser or other users, or submitted on or through this site, are given entirely at his/her own risk and Top Leader shall not be responsible for any loss or damage arising out of or in relation to the view, transfer or use of the Personal Information in whatever manner by the Users.

               B- Employer / Advertiser

     

  • Employer / Advertiser should use the site only for lawful purpose and seeking for potential candidate for your business. Both of you are entitled to access and use the site by Login ID and Password which provided by Top Leader. The Advertiser agrees that all information, including without limitation the Personal Information (defined below) obtained from the Site shall be used for recruitment purposes only. All such information shall be handled by the Advertiser in strict compliance with the Terms and Conditions and the Privacy Policy and shall not be disclosed to any third parties. Advertiser acknowledges and agrees that it shall disregard any information from Job applicants (either from the Job Seeker’s Page or otherwise) which is irrelevant to recruitment purposes.

     

  • All contents and data of any advertisement posted by the Advertiser on this site will be examined by Top Leader before formal publication is allowed. If Top Leader determines that any users in breach of the Terms of Use or any relevant provisions, Top Leader reserves the right to suspend or terminate our service and remove the Advertiser’s Page or any advertisement without any limitation, or upon request by Top Leader, the Advertiser shall amend or forthwith remove the relevant information on the Site. Advertiser shall be solely responsible for the contents of and materials contained in its advertisement and/or web page posted on this site. Top Leader reserves the right to remove or edit, or require the removal or amendment of, any advertisement or web page as it sees appropriate, or to terminate or suspend the Advertiser’s access and use of the Site and/or services offered on or through the Site, in accordance with the agreement for such services between Advertiser and Top Leader.


    Top Leader also reserves the right to change the service fee or institute new charges or fees, from time to time, as it deems appropriate. In the event that any Advertiser fails to pay the service fee or any other fees or charges due to Top Leader, Top Leader reserves the right to suspend or terminate the Advertiser’s web page and/or advertisement and/or right to access the Database, without prejudice to all other rights and remedies available to Top Leader.

  • In addition, Top Leader may invest in marketing campaigns to promote your employer brand (including but not only Google ads, Yahoo, Facebook ads, network companies ads and other programmatic buying strategies) and acknowledge that such promotion may be outside the domain of Top Leader or its subsidiaries / affiliates. Advertiser agree that all information related to the applicants provided thorough the site shall not be disclosed to any other parties.

              C- All Users 
              Users agree that:

  • Must not use screen scraping, data mining, robots or similar data gathering and extraction tools on this site for establishing, advancing or reproducing information contained on our Site on your own website or in any other publication, except with our prior written consent.

  • Must not print, download, duplicate, transmit or otherwise copy, reproduce, re-distribute, republish or use any personally identifiable information about other users save and except that the Advertisers may use the Database and/or Job applicants’ resumes and the related information. All unsolicited communications of any type to users are strictly prohibited.

  • Must not upload, post, publish, transmit, distribute or circulate any material in any way relating to our Site that contains viruses, Trojan horses, worms, corrupted files or other materials that may interrupt, damage or limit the functionality and operation of the Site, the services offered on the Site, or of any computer software or hardware or telecommunication equipment.

  • Must not post any content that is unlawful, fraudulent, discriminatory, threatening, abusive, libelous, defamatory, obscene or otherwise objectionable, or that contains sexual, ethnic, racial or other discriminating slurs, or that contains no relevant or constructive content. You must also not post any User Content that contains proprietary information, trade secrets, confidential information, advertisements, solicitations, chain letters, pyramid schemes, investment opportunities, or other unsolicited commercial communication (except as otherwise expressly permitted by us in writing), or encourages or causes spamming or flooding.

  • Must not post any content containing official identification information, such as social security number, passport number, national identification number, driver’s license number, immigration number, or any other similar number, code, or identifier. Posting such identification information may lead to identity theft and other adverse consequences.

  • Must not use the Site in any manner that may infringe the copyright, trademark, trade secrets or other intellectual property rights or violate the privacy or publicity or other personal rights of others.

  • Must not delete, revise or remove any material posted by any other person or entity.

  • Must not violate or attempting to violate the security of the Site including, without limitation, accessing data not intended for them or logging into a server or account which they are not authorized to access, attempting to probe, scan or test the vulnerability of a system or network or attempting to breach security or authentication measures without proper authorization, attempting to interfere with service to any user, host or network or sending unsolicited e-mail, including promotions and/or advertisements for products or services. Violations of system or network security may result in civil and/or criminal liabilities.

    2. Own Risk & Responsibility

    All users use this site and the Services (or other websites which are provided on this site) at its own risk, and shall be fully and absolutely responsible for its own activities and any loss, damages and/or liabilities arising there from. All users shall be responsible for their own communications and are responsible for the consequences of their activities on this site. Top Leader does not guarantee the truthfulness, accuracy or reliability of any of the communications posted by other users or endorses any opinions expressed by users. Top Leader reserves the right to expel any users and prevent their further access to this site at any time for breaching the Terms and Conditions or violating the laws and regulations and also reserves the right to remove any material which is abusive, illegal, disruptive or inappropriate at Top Leader’s sole discretion without notice and/or consent whatsoever.

    Top Leader reserves the right to monitor the Site and its contents at any time, but is not obliged to do so. Top Leader takes no responsibility whatsoever for any material on this Site that is not posted by Top Leader Hong. Top Leader shall NOT be responsible in any way for any decision, for whatever reason, made by any party seeking or posting jobs on this Site, or of any party responding to or posting advertisements on the Site.

    All Users agree that it is solely and fully responsible for the accuracy, truthfulness and legality of any information uploaded on the Site, and further undertakes and represents to Top Leader that all information provided or to be provided thereon are in compliance with the Terms and Conditions and the laws in Hong Kong or other relevant jurisdictions. However, Top Leader does not guarantee that any resume, information, data or advertisement will be viewed by any specific number of users or it will be viewed by any specific user or result in successful recruitment of personnel.

    Top Leader will provide a quality service to Advertisers and Applicants , however Top Leader do not assure that this site will operate error- free or the site server are free of viruses or other harmful mechanisms that any defects will be corrected. Top Leader will not be responsible for those costs , any loss or damage of whatever nature.


    This site is not directed to individuals under the age of eighteen (18), but if you are under the age of 18 or the age of majority in your jurisdiction, you must use this site under the supervision of a parent or legal guardian, or responsible adult.

    3. Restriction, Suspension and Termination of Use

    Any information provided by the user is inaccurate, in breach of any laws or contains indecent elements, Top Leader shall instantly abrogate the user’s account and membership without notice and reserves the right to take such action as it considers appropriate, desirable or necessary including but not limited to taking legal actions against such user.

    For the avoidance of doubt, upon termination of the User’s right of access to this Site and use of the services , Top Leader may also, without notice, (i) determine the membership of the User permanently; (ii) remove or de-activate any information uploaded or posted by such User on this site; (iii) demand immediate payment of the Service Fee and/or any other fees or costs incurred and owing to Top Leader by such User together with any interest thereon; and (iv) make a public announcement of the termination of membership of such User on this site.

    Top Leader reserves the right at any time to terminate or suspend immediately any user’s account or access to this site without notice, where Top Leader is of the opinion that the user has violated any law or regulation, and to take further action as Top Leader in its sole discretion considers appropriate, desirable or necessary, including removing any material which it deems abusive, illegal, disruptive or inappropriate. Top Leader shall not be liable to users or to any third party for any such modification, change, suspension, discontinuation or restriction.


    4. Relationship between Top Leader and the Users

    Top Leader uses its best endeavors to provide impartial recruitment services, and represents a media supporting information exchanged between Advertisers and Job applicants, but not in any manner be considered an agent, joint venture, partner or employer of any User. Top Leader will not be involved in dealings or disputes between Job Seeker and Advertiser and we shall not be responsible or held liable for the quality, security and legitimacy of the recruitment service.

    Top Leader shall not be bound by any agreement, warranty or representation made by such User to any other party or shall it be liable for any loss or damage suffered by any party in relation thereto.

    5. Intellectual Property Rights

    In consideration of the Services provided by Top Leader, applicants who upload information on this site agree to grant to Top Leader, at no cost, the right to use, amend, remove, publish, distribute, license or sub-license, sell and store such information, including all Intellectual Properties contained therein, for the purposes of providing Services to the Users and carrying out other business activities in relation.

    All the contents of Top Leader which exclusively holds trade mark, name, logo, design and data are protected by the relevant laws and regulations. It is prohibited from copying, transmitting, publishing, disseminating, broadcasting; circulating, displaying, modifying, selling, transferring, reproducing, modification, and distribution of them to any third-parties without limitation or in any way exploit any of the contents, whether in whole or in part. Top Leader reserves all its rights of enforcement of all its intellectual property rights or proprietary rights in the Contents, including without limitation against any use of any of the Contents that is not expressly permitted under the Terms and Conditions.

    6. Links with other External Sites

    This Site contains links to other third-party sites (the “External Sites”) on the Internet. These are provided and operated solely as a convenience to users, and not in any way as an endorsement by Top Leader of the details on such third-party sites. Top Leader has no control over or rights in such External sites and is not responsible the security, liable for any such third parties or for the availability of, or the materials located on or through any External sites.

    In addition, Top Leader shall not be responsible for the contents of any third-party sites linked to this site or any links contained in such third-party websites or any changes or updates, and does not make any representations or guaranties regarding the contents or accuracy of materials on such third-party sites.

    Top Leader shall not be responsible for any content or services provided by these External Sites, and disclaim all liability from anything that may occur when you utilize such third parties. We are additionally not responsible for any payment that may be asked by such third party. Users should contact the site administrator or webmaster for the applicable website if he/she has any concerns regarding such links or the materials located on that site.

    7. Disclaimer
    Top Leader does not guarantee successful conclusion of the employment by using the Website.

    Top Leader shall not be liable for any loss or damage arising from the inaccuracy, falsity, invalidity, illegality, unsuitability, incompleteness, unseemliness or unreliability of this Website and its services directly or indirectly. All users shall use this Website and its service at entirely their own risk. We shall not be liable for any loss or damage arising from or in relation to, and suffered by the User or any third party as a result of the use of the Services, reliance on any information on the Site or failure to provide the Services to the User for whatever reason.

    Top Leader makes effort to provide accurate information, however we make no warranties whatsoever as to the contents including user's personal information on this Website. The Website may link to third-party's websites of which are not operated by Top Leader; we shall not be responsible for any contents of the third-party's website. At the same time, Top Leader will use reasonable endeavors to ensure, however without guarantee, that the Site will be operated free of error and viruses, also the operation of this Site will be uninterrupted, timely and secured, or any problems will be corrected in a timely manner.

    8.Force Majeure

    Without prejudice to the provisions of these Terms and Conditions limiting or disclaiming liability, Top Leader is not liable for any failure or delay in performance resulting directly or indirectly from causes beyond its reasonable control, including without limitation, failure of the computer, power failure, telecommunication or other equipment, strikes, labor disputes, insurrections, civil disturbances, shortage of labor or materials, fires, floods, storms, explosions, act of God, war, acts of government, orders of domestic or foreign courts and non-performance of third parties.

    9.Governing Law

    The Terms of Use of Top Leader and any dispute or matter occurred by using the Website are governed and construed in accordance with the laws of Hong Kong Special Administrative Region of the People's Republic of China. The Terms and Conditions shall be governed by and construed in accordance with the laws of Hong Kong and the parties agree to submit to the non-exclusive jurisdiction of the Hong Kong courts for hearing and/or settlement of all disputes arising out of or relating thereto.

    Subject to the applicable laws, all users agree that the aggregate liability of Top Leader for all claims arising from or relating to its use of this site and the services, if any, shall be limited to the total amount of fees actually received by Top Leader in relation to its services provided to such user.

    10. Security Measures

    Any person who receives any personal information or data when operating and using this site and/or the services, including without limitation Advertiser(s), Top Leader’s affiliate(s) and business partner(s), acknowledges and agrees that it shall strictly comply with the relevant provisions relating to the protection of privacy and personal data protection under the Terms and Conditions and the Privacy Policy at the same standard applicable to Top Leader. In addition, such person also undertakes to procure any persons under or related to it who receives any personal data, including without limitation its affiliates, directors, officers, employees, representatives or agents, to handle such Personal Data with the highest standard of confidentiality and security and not to use such Personal Data for purposes otherwise contained in this Privacy Policy.

    11. Limitation of Liability

    Under no circumstances, Top Leader or their third-party licensors, be liable to any user on account of that user’s use or misuse of or reliance on this site. Top Leader shall NOT be liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces, or causes beyond its or their reasonable control, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, floods, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning.

    All users agree to indemnify Top Leader against any claims, losses, demands, injuries, liabilities, losses, damages, costs and expenses (including legal fees and litigation expenses on a full indemnity basis) arising from or relating to their use of this site or its contents or their breach of the Terms and Conditions, to the fullest extent permitted by applicable law. To the extent permitted by law, the maximum aggregate liability of Top Leader and its affiliates, and its and their third-party licensors, for all damages, losses and causes of action, whether in contract, tort (including negligence) or otherwise, shall be limited to the amount you paid Top Leader to use the site. This indemnification shall be in addition to all other obligations of users under the Terms and Conditions, and shall not prejudice any other rights or remedies available at law to Top Leader.

    12. Miscellaneous

    This Terms and Conditions shall constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes and replaces all prior or contemporaneous understandings, communications or agreements, written or oral, relating to the subject matters hereof. If any provision of this Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this Agreement, which shall remain in full force and effect.

    Top Leader shall have the right to amend or delete any provisions of the Terms and Conditions from time to time at its sole discretion without prior notice. Notification will be given to all Users in whatever Top Leader considers appropriate. After the notification is made, any continued use of the Site by the User will be deemed consent and acceptance to all changes made to the Terms and Conditions, and the User shall be bound by the amended provisions therein.
